martin savidge, cnn, sanford, florida. >> that may depend on how the judge rules tomorrow morning. let's bring back in our panel. jeff, just -- we talked about this in the 8:00 hour. that last witness that martin savidge talked about that the defense brought in by video, the neighbor that testified that was george zimmerman's voice, does that have much credibility? how many neighbors know what you sound like when you're screaming? >> no, i can't imagine that will have any significant impact on the jury. but boy, that expert who testified that trayvon martin was on top, that's a powerful witness. and at this point, i think it's going to be hard for the prosecution to argue that any way that george zimmerman was on top. there's really almost no argument left. and you saw that in the cross-examination that basically they were saying even if he's on top, he might still be -- zimmerman might have thrown the first punch. but i think the defense has really proved that trayvon martin was on top here. i think it's almost settled. >> and the interesting thing about that is look at what the p

martin savidge is joining us once again. he's been covering this case, sunny hostin and jose baez, the criminal defense attorney in florida as well. martin, there was a lot of confusion, a lot of uncertainty whether judge nelson would allowed trayvon martin's use of marijuana that day to be admitted as evidence. now she says it can be admitted. the defense and the prosecution will go at that presumably tomorrow. give us a little background now. what's at stake here? >> well, there's a lot of stake and there had been a great deal of hearing testimony that had been heard there was ever a jury as to what kind of evidence might be introduced regarding the background and the previous life you could say of 17-year-old trayvon martin. and the judge basically said you couldn't introduce any of that because he's the victim here and you need to stay focused on the va events of that evening. however, remember shiping bao? he said the trace amounts of marijuana found in trayvon's blood stream were insignificant. on the witness stand he

also joining us, sunny hostin, our cnn legal analyst, former federal prosecutor and cnn's martin savidge. this is obviously very important what the judge, debra nelson, is going to decide. what does it look like to you as a criminal defense attorney? do you think she's going to allow this animation to be shown to the jurors? because if it is, it could be in the words of some analysts out there potentially a bonanza for the defense. >> well, what we're looking at right now it doesn't look very good for the defense at this point. this witness -- now, when it comes to demonstrative evidence, florida law is very liberal when you're looking at opening statements and closing arguments because that's not evidence. but when you're actually trying to introduce something as evidence, evidence is very specific and must be very detailed, especially when you consider the appellate record that must be preserved. so in looking at this, this gentleman is testifying that he's basing a majority of this animation on consultation with the attorneys and not necessarily evidence that's actually been presented

i want to play more of martin savidge's interview with you with mark owe mare rar. o'mara. >> let's talk about the makeup of the jury. six women. one person of color and five who are mothers, correct? >> yes. interesting because the jury selection process is very intriguing to me. i enjoy the process. >> that the jury you wanted? >> yes. in this way. when we were going through it, i was surprised that the state struck the first black male that she vuk. they struck. i was surprised by that. they seemed to be moving down the path to get a bunch of white women. and i think that's inappropriate. i challenged them on that. the judge said they were removing white women because they were white women. we went to four and then further down the list. so in my perfect jury, i would like more of a demographic switch. maybe more males. but i'm very okay with the six people that we have now, for reasons that we talked about. i think they're very attentive and listening. >> do you think that maybe a man might take the self-defense, hear that differently than five women or six wome
